1: Liability and Exemptions
Our household goods carrier takes full responsibility for the safe transportation of your property, except as provided in the terms and conditions.
We are not liable for losses or damages caused by acts of God, public enemies, authority of law, or actions or defaults of the shipper or owner.
Our liability as a warehouseman applies to loss, damage, or delay caused by fire after the free time allowed by applicable tariffs.
We are not responsible for losses, damages, or delays resulting from your request to stop and hold the property in transit, defects or inherent vices of the article, atmospheric conditions, riots, or strikes.
Our liability does not extend to delays caused by highway obstructions or impassable routes, unless it is due to our negligence.
2: Cooperage and Baling
Necessary cooperage and baling of your property are subject to your cost, unless it is a result of our negligence.
3: Storage and Unclaimed Property
Unclaimed property may be kept in our facility or transferred to a public warehouse, with storage charges applicable.
If property remains unclaimed or is refused by the consignee, we may sell it at public auction after providing notice as per the terms of the contract.
In the case of perishable property, we may sell it to prevent deterioration if the consignee fails to receive or claim it promptly.
4: Limited Liability for Special Items
We are not liable for documents, specie, or articles of extraordinary value unless a special agreement is made, and their value is specified.
5: Liability for Explosives and Dangerous Goods
Any party shipping explosives or dangerous goods without disclosing their nature will be liable for any loss or damage caused by these goods.
6: Freight Charges and Delivery
The consignor or consignee is responsible for paying the freight charges and other lawful charges.
We will not deliver the property until all charges have been paid, except when the consignor stipulates otherwise.
If the consignee is an agent and has no beneficial title, they are not liable for transportation charges beyond those initially billed, provided certain conditions are met.
7: Substitution of Bill of Lading
If this bill of lading is issued in exchange for another, the terms and conditions of the prior bill of lading will remain applicable.
8: Alterations and Enforceability
Any alterations made to this bill of lading without the agent's notation will be disregarded, and the original terms will be enforceable.
